Since the accident report was submitted after 24 hours, I violated the agreement. Thus the credit card company denied my claim.
Brian Marquina: As a former auto claim adjuster, the thing that struck me was the high labor charges. I remember the average being around $30 and per this site below, appears that in AK, they are almost double, the lowest being $65 to $90 an hour. IF, you had personal insurance, they might dispute that amount, but if AK average is that high, cant argue. http://www.automd.com/shops/AK/It appears that in AK, they can claim diminished value. There are only a couple of things you can dispute, and that is administrative fees which with most rentals runs on average of $150 and loss of use. Many times, as an adjuster would refuse to pay administrative,! since our argument was it was the cost of doing business. Also, will loss of us, the rental company MUST prove that while the car was being repaired, that they had NO OTHER cars available to rent, thus losing money. Melissa Lavallie: I thought the collision damage waiver had an upper limit. Eg for damage of 10,000 the driver's waiver insurance would cover around the first 1000. Rental company claims the rest on their insurance.

Your signature (even electronically) says you did understand it, so they can prove you did know about it. Don't belittle yourself in front of a lawyer, not never.1) Forget the repair bill though, that one is sewn up tight. They have a stack of paperwork showing exactly what they lost and all the costs involved, you have a photograph and a personal opinion that it shouldn't have cost that much. Court cases are decided by cold hard documentation, not principles of fair and unfair. You've got nuffin.2) This is the part where you've got a case. You have a witness who will testify that you did everything within your power to comply with the conditions of the rental agreement, which is good. That witness will also testify that the other party to the agreement (the rental company) waived or amended that condition of their own free will, which is very good. If you also have the ex! act date & time of any and all phone calls and names of who you spoke to, even better.3) The whole thing will probably be disputed in your home state. That's because your dispute isn't with the rental company, it's with your credit card provider. The rental company isn't causing this problem, their case is cut and dry: You said you'd take responsibility for damage to their vehicle, you damaged their vehicle and it's your responsibility. The problem is your credit card provider trying to weasel out of their obligations on a small technicality, and that's who you want to dispute.You have a couple of advantages in this case. First, when an individual sues an insurer (that rental car damage agreement is a form of insurance), most judges will not favour the insurer at all. Second, your lawyer will ask the rental company to testify that they agreed to waive those time limit conditions. You also have your witness testifying that you did everything as per the contract's requ! irements, which will put pressure on the credit card company to explain! why they think they shouldn't have to honour their end of the agreement. Lahoma Beadell: It seems you violated the terms of the rental agreement, and they don't have their attorney's draw up these contracts for nothing, you're probably going to be hung out to dry on this one. The rental company is asking for everything they're entitled to. You should have contacted the police authorities anyway to at least have proof you contacted them immediately. They would likely have told you that if there were no injuries, to stop in a police station before you left.
